Terms of Service — myHOAWiz

These Terms of Service (“Terms”) govern your access to and use of myHOAWiz, a software-as-a-service platform operated by WizPro Software LLC (“we,” “us,” or “our”). By accessing or using myHOAWiz, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Description of Service

myHOAWiz is a cloud-based HOA (homeowners association) management platform that provides tools for property management, resident communication, financial management, payment processing, document storage, and related services. Features vary by subscription plan.

2. Accounts and Access

You must create an account to use myHOAWiz. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate and complete information when registering. Accounts are not transferable.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or pose a security risk.

3. Subscription and Payment

myHOAWiz is offered on a monthly subscription basis. Fees are charged in advance at the beginning of each billing period. All fees are in US dollars and are non-refundable except as required by law or as expressly stated in these Terms.

Payment is processed securely through our payment processor. We do not store your full payment card information on our servers. By subscribing, you authorize us to charge your payment method for the applicable subscription fee each billing period.

If a payment fails, we will notify you and attempt to retry the charge. Accounts that remain past due will be suspended after 14 days and permanently deleted — including all associated data — after 30 days from the first failed payment. We will send escalating email notices before suspension and deletion occur.

4. Free Trial

We may offer a free trial period for new accounts. At the end of the trial, a paid subscription is required to continue using the platform. We reserve the right to modify or cancel trial offers at any time.

5. Cancellation and Data Deletion

You may cancel your subscription at any time through the account settings. Cancellation takes effect at the end of the current billing period — you retain access until that date. We do not provide prorated refunds for partial billing periods.

Upon cancellation, all account data — including properties, resident records, financial records, documents, and uploaded files — will be permanently and irrevocably deleted at the end of the billing period. You are responsible for exporting any data you wish to retain before the cancellation date. We cannot recover deleted data.

6. Acceptable Use

You agree not to:

Use the platform for any unlawful purpose or in violation of any applicable law
Transmit any harmful, offensive, or fraudulent content
Attempt to gain unauthorized access to any part of the platform or other accounts
Interfere with or disrupt the platform or its infrastructure
Use automated tools to scrape or extract data without our written permission
Resell or sublicense access to the platform without our written permission

7. Data and Privacy

Your use of myHOAWiz is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for obtaining any necessary consents from your community members before entering their personal information into the platform.

You retain ownership of all data you enter into myHOAWiz. By using the platform, you grant us a limited license to store, process, and display that data solely to provide the service to you. We do not sell your data to third parties.

8. Payment Processing

myHOAWiz integrates with third-party payment processors to facilitate HOA dues collection. Payment card data is collected and stored exclusively by our payment processor in a PCI-compliant environment. We do not store, transmit, or have access to full payment card numbers or CVV codes.

By enabling online payment collection, you agree to the payment processor's terms of service and acknowledge that processing fees may apply and be passed to residents as permitted by applicable law.

9. Intellectual Property

myHOAWiz and all associated software, design, trademarks, and content are the exclusive property of WizPro Software LLC. Nothing in these Terms grants you any rights in our intellectual property other than a limited license to use the platform as described herein.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZPRO SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless WizPro Software LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

13. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in [Your County], [Your State].
